Types of Criminal Cases We Handle
Infractions are the lowest level of criminal cases. These cases do not involve jail time, and are usually punished by a fine. The most common type of infractions are traffic offenses.

The investigative/pre-filing stage of a case occurs when law enforcement is still investigating the case and the prosecutor has not yet decided to file criminal charges. The pretrial stage of a case consists of everything that happens after the case is filed but before it goes to trial. While every case is different, this usually includes your bail hearing, investigation of the facts of your case, reviewing the prosecution’s evidence against you, and negotiating with the prosecutor to obtain a favorable resolution before trial.
Crucially, this is the stage where many of your legal defenses can be raised. For instance, if the police violated your constitutional rights by searching your house without a warrant, failing to advise you of your right to an attorney, or refusing to stop an interrogation after you invoked your right to remain silent, your attorney can file a pretrial motion to have the evidence suppressed, or kept out of court.
Trial is where your case is presented to a judge or jury. The prosecutor will present the evidence against you by having witnesses testify and introducing documents and other evidence. Then your attorney will present any evidence in your favor. Then the judge or jury will deliberate and will deliver a verdict of guilty or not guilty.
The sentencing and restitution stage of the case occurs if you are convicted at trial or enter a guilty or no contest plea. If you enter a plea of guilty or no contest, your attorney will negotiate a favorable sentence and restitution with the prosecutor. If you are found guilty after a trial, your attorney and the prosecutor will argue to the judge for a certain sentence.
The post-conviction stage is everything that happens after your conviction. There are a variety of ways for your attorney to reduce the charges you were convicted of or clean up your record, often by means of expungement.
